Welcome to KRUSH, an iOS fitness app designed to help users stay focused during workouts. By downloading, accessing, or using KRUSH (the "App" or "Services"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree, please discontinue use of the App immediately.These Terms apply to users in the United States (including California), Canada, and the United Kingdom. Krush Fitness Labs LLC (doing business as Krush Fitlabs) ("we," "us," or "our") reserves the right to modify these Terms at any time.

1. Acceptance of Terms
By accessing or using KRUSH, you agree to these Terms and any additional terms applicable to certain features or services. If you are using the App on behalf of an entity, you represent that you have authority to bind that entity.

2. Elgibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use KRUSH. By using the App, you confirm that you meet this age requirement. We do not knowingly allow use by minors under 18 without parental consent. Parents or legal guardians are responsible for monitoring the use of the App by minors under their supervision.By accessing or using KRUSH, you agree to these Terms and any additional terms applicable to certain features or services. If you are using the App on behalf of an entity, you represent that you have authority to bind that entity.

3. Account Registeration
To access features like progress tracking, session notes, or subscriptions, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials (e.g., email and password) secure and confidential.
- Notify us immediately at [support@krushfitapp.com](mailto:support@krushfitapp.com) of any unauthorized use or security breach of your account.

We may suspend or terminate accounts for inaccurate information or violations of these Terms.

4. Use of The App
KRUSH is intended for personal, non-commercial use to support focused workouts through distraction blocking, gamification, and session note editing. You agree to use the App responsibly and in accordance with these Terms and applicable laws. You may not:To access features like progress tracking, session notes, or subscriptions, you must create an account. You agree to:
- Use the App for unlawful, harmful, or unauthorized purposes.
- Interfere with, disrupt, or overburden the App's functionality or servers (e.g., via hacking, viruses, or excessive automated requests).
- Reverse-engineer, decompile, or exploit the App's software, including integrations with Apple's Screen Time APIs, Supabase, or third-party tools like Google Analytics.
- Share, sell, or redistribute App content or features without permission.
- Use the App in a way that infringes on others' rights or violates privacy laws.
The App is not a substitute for professional medical, fitness, or health advice—consult a qualified professional for personalized guidance.

5. Privacy and Data
We are committed to protecting your privacy. Please review our Privacy Policy to understand how your data (e.g., account details, device info, session notes) is collected, used, shared, and stored. By using the App, you consent to the practices described in the Privacy Policy.

6. Paid Subscriptions and Billing
Certain features (e.g., advanced gamification or unlimited sessions) are available through paid subscriptions via Apple's In-App Purchases (IAP). By subscribing, you agree to:
- Pay all applicable fees, taxes, and charges.
- Authorize Apple to charge your provided payment method for recurring subscriptions until canceled.
- Manage subscriptions and cancellations through your Apple ID account settings or the App Store—refunds are subject to Apple's policies and our discretion. We do not handle direct billing or store payment card details.
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Prices may change with notice.

7. Disclaimer of Warranties
KRUSH is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or uninterrupted/error-free operation. We do not guarantee results from using the App, accuracy of tracking, or compatibility with all devices. Apple Screen Time features depend on your device settings and may not block all distractions.

8.Limitation of Liability
To the fullest extent permitted by law, we, our affiliates, and licensors (including Apple, Supabase, Google, and Meta) are not liable for:
- Any direct, indirect, incidental, consequential, special, or punitive damages arising from your use or inability to use the App.
- Loss of data, profits, goodwill, or other intangibles.
-Any health-related issues or injuries from workouts.Our total liability shall not exceed the amount you paid us in the past 12 months (or $100 if no payments). This applies even if advised of the possibility of such damages.

9. User-Generated Content
You may create and save session notes in the App. You retain ownership of your content but grant us a non-exclusive, royalty-free license to store, process, and use it to provide the Services (e.g., via Supabase). You agree not to upload illegal, harmful, or infringing content. We may remove content violating these Terms without notice.

10. Intellectual Property
All content, trademarks, designs, software, and materials in KRUSH (including gamification elements and interfaces) are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission. Apple, Supabase, Google Analytics, and Meta tools are subject to their respective terms.

11. Changes to Terms
We may update these Terms periodically to reflect changes in the App, laws, or practices. We'll notify you via email, app notice, or website posting for material changes. Continued use after updates constitutes acceptance. 13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Delaware. For users in Canada or the UK, mandatory local laws may apply. You acknowledge and agree that Apple is a third-party beneficiary of these Terms and may enforce them against you as a user of the App.
